VMA Submits Comments to MN Proposed PFAS Ruling

The state of Minnesota is one of the first states to propose a full PFAS band and has a PFAS reporting requirement on items containing intentionally added PFAS beginning on January 1, 2026. This is now before the EPA reporting requirement and would affect many members. In April a proposed draft rule of what would be required to report was released, and comments on this proposed rule were requested.

VMA reviewed the proposed rule and identified many concerning items that would be incredibly burdensome for our members to meet. The proposed rule is very complex and confusing, and contains elements on due diligence, concentrations and testing, timelines, and fees that are concerning to the industrial valve and flow control industry. Further, other states may look to Minnesota's approach to PFAS as a guideline for their own approach. On May 21, 2025, VMA submitted comments to Minnesota outlining our concerns and provided revisions to the rule.
